Content Policy

This Content Policy describes how we we may create, modify, and remove content from hashgear.shop (the “Site”).


OVERVIEW

All products available for purchase on the Site are generated automatically from social media content using a proprietary algorithm. Because social media content can be inappropriate, offensive, or potentially infringe on copyright or trademark rights, the Site maintains a number of compliance mechanisms to minimize the scale and frequency of such content.

OFFENSIVE CONTENT

We value diversity and respect for others, and we strive to avoid selling offensive products, so we reserve the right to monitor, moderate, and remove products that promote hatred, intolerance, discrimination, or violence. Please direct any concerns to: [email protected]

COPYRIGHTED MATERIAL

All printed material, text, and images are generated automatically using a proprietary algorithm, with a focus on short text fragments, which are rarely copyrighted.  In the exceedingly rare case that some content may be considered an infringement of copyrighted material, we will comply with the DMCA  take-down process.

DIGITAL MILLENNIUM COPYRIGHT ACT COMPLIANCE

If you are a copyright owner or an agent thereof and believe that any Content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;

- Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;

- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

TRADEMARKED MATERIAL

All printed material, text, and images are generated automatically using a proprietary algorithm, resulting in a phrase accompanied by a Hashgear logo, which contains a hashtag as a reference to a conversation happening on social media.  In general, the source of goods for all of our products should be clear in that every product is accompanied by our brand identity.  That said, there may arise circumstances where hashtag or other textual content is trademarked and we make every effort to avoid selling products that infringe on the rights of any trademark owner.

We have instituted the following compliance mechanisms to prevent trademarked material from appearing on our store:

- All social media content is automatically checked against a listing of all hashtag-related trademarks registered with the United States Patent and Trademark Office (USPTO). If content is an exact match of a trademarked hashtag, we will not generate any products related to that hashtag.  Our USPTO listing is updated periodically to reflect any updated trademarks on a continual basis.

- We have manually created a list of text related to trademarked material commonly appearing in social media in an attempt to avoid generating products that would potentially infringe on trademark owners' rights.

TRADEMARK MATERIAL INFRINGEMENT COMPLAINTS

If you are a trademark owner or an agent thereof and believe that any Content infringes upon your copyrights, you may submit a notification with the following information:

- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

- Identification of the trademarked material claimed to have been infringed, or, if multiple trademarked materials at a single online site are covered by a single notification, a representative list of such works at that site;

- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;

- Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;
